Terms of service
Terms of Service
Welcome to Meadowa. These Terms of Service govern your use of our website, online store, products, content, and related services.
Throughout these Terms, “Meadowa,” “we,” “us,” and “our” refer to Meadowa LLC.
By accessing our website, placing an order, creating an account, or otherwise using our services, you agree to these Terms of Service and the policies referenced on our website, including our Privacy Policy, Shipping Policy, and Refund Policy.
Please read these Terms carefully. If you do not agree with them, please do not use our website or services.
Nothing in these Terms limits any consumer rights or remedies that cannot legally be waived.
1. Online Store Terms
You may use our website and services only for lawful purposes.
By placing an order, you represent that you have the legal capacity to enter into a purchase agreement or are using the website with the involvement of a parent or legal guardian where required by law.
You agree to provide accurate, current, and complete information when placing an order or creating an account.
You are responsible for maintaining the confidentiality of any account credentials and for activity conducted through your account.
You may not use our website to engage in fraud, interfere with our services, gain unauthorized access to our systems, or violate applicable laws or the rights of others.
2. Products and Product Information
We make reasonable efforts to accurately display and describe our products, including their colors, materials, dimensions, features, photographs, and specifications.
However, colors and appearance may vary slightly depending on your screen, device settings, lighting, photography, or normal manufacturing variations.
Product descriptions, specifications, packaging, availability, and other details may be updated from time to time.
All products are subject to availability. Adding a product to your cart does not reserve it.
We may discontinue a product or limit available quantities where reasonably necessary.
3. Orders and Cancellations
Submitting an order constitutes an offer to purchase products from Meadowa.
An automated order confirmation acknowledges that we received your order but does not necessarily mean that the order has been finally accepted.
We reserve the right, where permitted by law, to refuse, limit, or cancel an order for legitimate reasons, including:
• product unavailability;
• pricing or product-information errors;
• suspected fraud or unauthorized payment activity;
• payment authorization problems;
• shipping restrictions; or
• quantities that reasonably appear to be intended for unauthorized commercial resale.
If we cancel an order after payment has been collected, we will refund the applicable amount.
Order Changes
Please review your products, quantities, colors, billing information, and shipping address carefully before completing checkout.
If you need to change or cancel an order, contact us as soon as possible. We will make reasonable efforts to help, but we cannot guarantee changes or cancellations once processing or fulfillment has begun.
4. Prices, Payments, and Promotions
Prices displayed on our website may change from time to time.
The price applicable to your purchase will generally be the price displayed when you submit your order, subject to correction of genuine errors as permitted by law.
Applicable taxes, shipping charges, discounts, and other charges will be shown during checkout where required.
By submitting payment information, you represent that you are authorized to use the selected payment method.
Payments may be processed through Shopify or other authorized payment providers.
Promotions, discount codes, giveaways, bundles, and special offers may have separate conditions, exclusions, expiration dates, or quantity limits.
Unless otherwise stated, promotional offers have no cash value and may not be combined with other promotions.
5. Shipping and Delivery
Shipping destinations, processing times, estimated delivery times, available shipping methods, and related information are explained in our Shipping Policy.
Any delivery dates shown are estimates unless expressly stated otherwise.
We will make reasonable efforts to ship your order within the timeframe communicated to you.
If we cannot ship your order within the promised timeframe, or within the period required by applicable law where no specific timeframe was provided, we will handle the delay, cancellation opportunity, and any required refund in accordance with applicable law.
Delivery after shipment may also be affected by carrier delays, severe weather, transportation disruptions, incorrect shipping information, holidays, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address.
If an order arrives damaged, contains the wrong product, or tracking indicates delivery but you cannot locate the package, please contact us promptly.
6. Returns and Refunds
Returns, refunds, damaged products, defective products, incorrect items, return eligibility, and applicable return timeframes are governed by our Refund Policy.
Please review our Refund Policy before making a purchase.
Nothing in our Refund Policy or these Terms limits consumer rights that cannot legally be waived.
7. Product Use and Outdoor Safety
Meadowa products should be installed, used, cleaned, and maintained appropriately and in accordance with any instructions or warnings provided with the product.
Because certain Meadowa products contain glass and are designed for outdoor hanging, customers should periodically inspect the product and its hanging or mounting equipment for damage, wear, looseness, or deterioration.
You are responsible for selecting a suitable and secure location and ensuring that any hook, pole, branch, bracket, or other support is capable of safely holding the product.
Products should be removed or secured when severe weather, high winds, falling branches, ice, damaged supports, or other conditions could make continued use unsafe.
Do not continue using a product that is broken, cracked, damaged, or otherwise appears unsafe.
8. Bird Feeding and Wildlife
Wild animals behave independently and their activity cannot be guaranteed.
Purchasing, installing, or using a Meadowa bird feeder does not guarantee that hummingbirds or other birds will visit or use the feeder.
Bird activity can vary based on location, habitat, season, migration, weather, natural food availability, feeder placement, feeder maintenance, local bird populations, and other environmental factors.
Customers are responsible for cleaning and maintaining bird-feeding products appropriately and following responsible bird-feeding practices.
9. Educational Content
Meadowa may provide educational articles, bird identification information, feeding guides, wildlife photography, videos, graphics, social media content, and other information relating to hummingbirds, backyard birds, wildlife, nature, and bird feeding.
We make reasonable efforts to provide accurate and trustworthy information.
However, wildlife behavior, scientific understanding, environmental conditions, and recommended practices may vary by location or change as new information becomes available.
Meadowa's educational content is provided for general informational and educational purposes and is not a substitute for veterinary, medical, legal, environmental, or other professional advice.
Where specialized guidance is required, consult an appropriately qualified professional or relevant wildlife authority.
10. Intellectual Property
Unless otherwise stated, Meadowa's website and original content are owned by or licensed to Meadowa and may be protected by copyright, trademark, trade dress, and other intellectual property laws.
This includes, where applicable, our:
• brand name and logos;
• product photography;
• wildlife photography;
• articles and educational content;
• videos;
• illustrations and graphics;
• product descriptions;
• website design; and
• other original creative materials.
You may use our website for personal, non-commercial purposes.
Unless authorized by us or permitted by law, you may not reproduce, republish, sell, license, modify, systematically scrape, distribute, or commercially exploit Meadowa-owned content.
Nothing in these Terms transfers ownership of Meadowa's intellectual property to you.
11. Reviews and User Content
Customers may have opportunities to submit reviews, photographs, comments, testimonials, questions, or other content.
Any review or testimonial you submit must reflect your genuine experience or opinion and must not be false, misleading, fraudulent, defamatory, unlawful, or submitted in violation of another person's rights.
If you received compensation, a free product, discount, or another material incentive connected with a review or testimonial, any disclosure required by applicable law must be made.
You retain ownership of content that you own.
By voluntarily submitting content to a Meadowa feature intended for reviews, testimonials, or public display, you grant Meadowa a non-exclusive, worldwide, royalty-free license to display, reproduce, adapt, and use that content in connection with operating and promoting Meadowa, subject to applicable law.
We may decline to publish or remove content that violates these Terms or applicable law.
12. Third-Party Services and Shopify
Our online store is hosted using Shopify.
We may also use third-party providers for payment processing, fulfillment, shipping, analytics, communications, reviews, advertising, and other services.
These third parties may operate under their own terms and privacy policies.
Meadowa is responsible for products sold by Meadowa through our store. Shopify and other technology providers are not the seller of Meadowa products unless specifically stated otherwise.
Our website may also contain links to third-party websites or resources. We are not responsible for the independent content, policies, security, or practices of third-party websites simply because we link to them.
13. Privacy
Our collection and handling of personal information are described in our Privacy Policy.
By using our website, you acknowledge that information may be processed by Meadowa and service providers that help us operate our store, process payments, fulfill orders, provide customer support, analyze website activity, prevent fraud, and perform other legitimate business functions.
Please review our Privacy Policy for more information.
14. Prohibited Uses
You may not use our website or services to:
• violate applicable laws or regulations;
• engage in fraudulent, deceptive, or malicious activity;
• infringe intellectual property, privacy, or other legal rights;
• impersonate another person or organization;
• provide intentionally false or misleading information;
• introduce viruses, malware, or harmful code;
• gain unauthorized access to accounts, systems, or data;
• interfere with the security or operation of our website;
• send spam or unauthorized solicitations through our services;
• collect personal information about others without authorization; or
• use Meadowa's name, content, or branding in a manner that falsely suggests sponsorship, endorsement, or affiliation.
We may suspend or restrict access where we reasonably believe these Terms have been materially violated.
15. Disclaimers and Limitation of Liability
Nothing in these Terms excludes warranties, consumer protections, remedies, or liabilities that cannot legally be excluded or limited.
To the fullest extent permitted by applicable law, Meadowa does not guarantee that our website will always be uninterrupted, error-free, or available at all times.
Except for any warranty expressly provided by Meadowa and any rights provided by applicable law, our website and services are provided on an “as available” basis.
To the fullest extent permitted by law, Meadowa and its affiliates, employees, contractors, and service providers will not be responsible for indirect, incidental, special, punitive, or consequential damages arising from use of our website, services, or products where such damages may legally be excluded.
Meadowa is not responsible for loss or damage caused by improper installation, misuse, unauthorized modification, failure to maintain a product, failure to follow provided instructions, or use of damaged products, except where applicable law provides otherwise.
16. Governing Law and General Terms
These Terms are governed by the laws of the State of Wyoming and applicable federal laws of the United States, without regard to conflict-of-law principles.
Where permitted by law, disputes relating to these Terms or our services may be brought before courts of competent jurisdiction in Wyoming.
Nothing in this section removes consumer protections or jurisdictional rights that cannot legally be waived.
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms, together with policies expressly incorporated by reference, constitute the agreement between you and Meadowa regarding your use of our website and services.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, services, business practices, website, or legal requirements.
The current version will always be available on this page.
Where required by applicable law, we will provide appropriate notice of material changes.
The “Last updated” date at the top of this page indicates when this version became effective.
